A "loving son, brother and uncle" who died after being hit by a car was killed in a "horrible mistake", a court heard.

James Roberts, 24, from Alne, North Yorkshire, died after he was hit by the white Audi on Silver Street in Scarborough shortly before 01:45 GMT on Saturday.

Cory Davies, 26, of Victoria Park Avenue in Scarborough, has been charged with murder over the incident and appeared at Leeds Crown Court on Thursday.

Prosecutor Nathan Davies told the court Mr Davies accepted he was driving the car, but said he he did not mean to hit Mr Roberts, adding, "this is a horrible mistake, a horrible accident".

Mr Roberts' family described him as "the most incredible man" in an earlier tribute.

"He had the unique ability to light up every room that he entered. The world feels significantly darker without his presence," they added.

The Recorder of Leeds, Guy Kearl KC, set a provisional trial date of 8 September.

Mr Davies, who appeared in court via a video link from HMP Hull, is due to appear at Leeds Crown Court for a pre-trial preparation hearing on 8 April.

He did not enter a plea during Thursday's hearing.

Two other men arrested on suspicion of murder in relation to the incident have been released on bail, the court heard.
